…Lawyers petitions IGP, Lagos SCID, Suspects, alleges forging Supreme Court Judgment

In what appears to be like a war of attrition that would throw up a protracted legal battle against the Nigerian police and some suspects who engaged the services of some policemen to subvert justice, a lawyer has petitioned the Inspector General of Police, (IGP); State Criminal Investigation Department, Panti Police Station, Yaba and Area J Command, Elemoro, Ajah for illegally deploying about 20 mobile policemen to unlawfully cease his client’s property.
Barr. Giwa-Amu of Chacole & Darda Chambers, Solicitors and Property Consultants, to ROCKSTON SHELTER COMPANY LIMITED of No 6, Ayinde Giwa Street, Surulere, Lagos State, Nigeria, in a petition to the IGP against the suspects and dated 3rd December, 2021 said that their Clients’ complained that on the 2nd of December, 2021 that Adamakin Investment Works LTD of No 7, Lawani Street, Jibowu, Yaba, Lagos State; Mr. Kunle Awoma also No 7, Lawani Street, Jibowu, Yaba, Lagos State and Mr. Tajudeen Abioye of NO 33, Subuola Street, Dopemu, Agege, Lagos State illegally engaged the services of a group of 20 Mobile Policemen and Soldiers, before storming their Client’s site at Olopameta Community, Hopeville Estate Waterfront, Sangotedo, Ibeju-Lekki, Lagos State and took it over.
According to Barr. Giwa-Amu in his petition alleged that his client has a Supreme Court Judgment dated 14th day of July, 2000 in Suit No: SC/48/1992 to execute, and proceeded to forcefully and criminally take possession pursuant to same.
Not only that, during the operation, the suspects were said not to have or did not go to “our Client’s premises with a Sheriff of the Lagos State High Court or Bailiff of the Supreme Court.”
Part of the petition stated “That the said suspects proceeded to paste Notices and signboard and inscriptions on the Walls of the Estate alleging that the Supreme Court gave a judgment which entitled the suspects to take possession.
To support their petition, they attached photographs of the same signpost and inscriptions the suspects allegedly placed at strategic places and a copy of Supreme Judgment to buttress their claim.
Elaborating further in the Petition, stated five offences the three suspects committed which included amongst others Forgery of Supreme Court Judgment in SC/48/92 Khalid & Dibbo Transport LTD and S.T. Odumade and & 2ORS; unlawful use of policemen to take possession of all property belonging to ROCKSTON SHELTER COMPANY LIMITED; and unlawful use of firearms and ammunition.
Other alleged offences include unlawful use of soldiers to unlawfully “take possession” of all property belonging to ROCKSTON SHELTER COMPANY LIMITED at Olopameta Community, Hopeville Estate Waterfront, Sangotedo, Ibeju-Lekki, Lagos State and Impersonation of Attorney of late Madam Iyalode Efunroye Tinubu Estate.
Investigation revealed that “the said suspects did not come to our Client’s premises with a Sheriff of the Lagos State High Court or Bailiff of the Supreme Court and the suspects proceeded to paste Notices and signboard and inscriptions of the Walls of the Estate alleging that the Supreme Court gave a judgment which entitled the suspects to take possession. Attached herewith are photographs of the same signpost and inscriptions.
The petitioner further stated that no such judgment as claimed by the suspects “exists and what was shown by the suspects is a forgery as our application to the Supreme Court for the Certified True Copy of the said Judgment reveals.
“That upon our further search we discovered the said forged judgment relates to and concerns 19, Agege Motor Road, Idi-Oro, Lagos State and not Olopameta Community, Hopeville Estate Waterfront, Sangotedo, Ibeju-Lekki, Lagos State.
Also, “That the name mentioned in SC/48/1992 is one Mr. Akingbehin Tinubu and not Late Madam Iyalode Efunroye Tinubu whose Estate the suspects now impersonate and purported to act on behalf of.
That the suspects have also at different times impersonated the Executors of the Estate of the Late Iyaloja Abibatu Mogaji (Mother of the former Governor of Lagos State) to carry out their nefarious actions.
With the benefits of all the foregoing and the zeal to ensure that justice is not only done but served, Barr. Giwa Amu in his petition is calling on IGP Usman Alkali Baba to use his good office to cause a detailed investigation of this matter with a view to bringing the suspects to Justice” and also ensure that policemen are not used to frustrate the execution of legitimate court judgments by using policemen to utter the course of Justice.
Efforts to reach the Lagos State Police spokesperson, CSP Adekunle Ajisebutu was not possible and a message was sent to his WhatsApp to respond to the allegation of using 20 mobile policemen to cease the site was not responded to.
It would be recalled that earlier in the year, The lawyer had written a petition against the Inspector General of Police alleging infringement on the fundamental Human Rights of his clients, harassment, breach of fundamental human rights to personal liberty and freedom of movement of his clients by officers of the Nigerian Police.
