PDP Wins As Appeal Court Dismisses Judgment Sacking Its’ Anambra Executives

The Court of Appeal in Abuja has nullified the judgment of the Federal Capital Territory (FCT), High Court which ordered the sack of the Anambra State Peoples Democratic Party (PDP), executive committee.

Samuel Anyakolah had filed a suit marked HC/CV/774/2021 at the FCT High Court Abuja, claiming that the PDP imposed the state chairman, exco and other national delegates on members in its south-east zonal congress of March 6, 2021.

Olukayode Adeniyi of the FCT High Court had consequently ruled on June 9, that all congresses and designations made by the PDP were nullified and set aside on the grounds that the PDP violated its constitution in the conduct of the south-east zonal congress of March 6, 2021, and the appointments made thereafter.

Discontented with the decision of the FCT High Court, the PDP and Uchenna Obiorah in their separate appeals marked CA/A/359/2021 and CA/A/CV/368/2021 approached the Appeal Court to set aside the judgment of the trial court.

Delivering Judgment on the two suits brought before the court on Friday, the three-member panel led by Stephen Adah, upheld the appeals filed against the judgment of the lower court.

Adah held that the lower court lacked the territorial jurisdiction to have heard the suit brought before it on the dispute over the leadership of the PDP in Anambra State.

The Appeal Court, therefore, dismissed the judgment ordering the sack of the Anambra PDP executives.
